What you agree to when you subscribe

These terms govern the Agnetia subscription: what you are buying, what it costs, how it is charged, how it is cancelled and what you can claim. They are the terms you accept when you register a payment method, and they prevail over the Legal notice in everything concerning the contract.

Agnetia is operated by a company registered in Spain; its legal name, tax number, address and registry entry will be published here as soon as they are completed. The rest of the terms — price, deadlines, withdrawal and cancellation — is accurate as it stands and binding from now.

The other party is you, as a learner. If you are contracting as a consumer — outside a professional activity — consumer protection rules also apply to you, in particular Spanish Royal Legislative Decree 1/2007. Where these terms say anything less favourable than those rules, those rules win.

Subscribing requires legal capacity. If you are under the age of majority, you need authorisation from whoever holds parental responsibility or guardianship.

What you are buying

Agnetia is a digital service for speaking practice in a foreign language: a voice agent that asks, listens, corrects and asks again, together with written review exercises and a level estimate. It is provided over the internet through agnetia.com and the Android app.

The full, current description of the service is on About us, and how payment works is on How it works. Both form part of the pre-contractual information given to you before you subscribe.

Agnetia is not a formal course, does not prepare you for any specific official exam and certifies no level. What you are buying is access to the tool, not a learning outcome.

Your account

  • The account is personal and non-transferable. It may not be shared or assigned.
  • Activating it requires verifying your email with a single-use link.
  • You are responsible for keeping your password confidential and for what happens in your account. Agnetia will never ask for it outside its sign-in screen.
  • If you see access you do not recognise, change your password: doing so closes the open sessions. And tell us.
  • Sign-up may be limited to an invitation list during the current opening phase.

Price, taxes and invoices

  • The price in force is the one shown on How it works and the one displayed on the payment screen before you confirm. It is deliberately not repeated here: an amount written in two documents is an amount that will one day say two things.
  • It is a single monthly fee. There is no sign-up fee, no minimum term, no extras and no different plans.
  • For customers in the European Union the advertised price includes VAT: it is the amount charged to the card. The tax is calculated by the payment provider according to your country and broken out on the invoice.
  • If you are buying as a business, you can enter your VAT number on the payment screen.
  • The catalogue is in euros. Outside the eurozone the payment provider may show and charge you in your local currency; the invoice is still in euros.
  • Every charge generates a numbered invoice, which you view and download from your profile.

How you subscribe, and the 24 hours of courtesy

  1. 01. You sign up and verify your email. No card is asked for in the sign-up form. Nothing has been bought at this point.
  2. 02. You register a payment method. You are asked on first access, with the session already open. The card number is typed on the payment provider's page and does not reach Agnetia's servers. Saving it generates no charge. On confirming, you accept these terms and the contract is formed.
  3. 03. 24 hours of courtesy begin. The whole product, with nothing cut down, with the same balance cap a month of subscription brings. The first charge lands when that period ends, not before. The courtesy is once per person: cancelling and coming back does not grant another 24 hours.

You will receive confirmation of the contract and every invoice at the email address linked to your account, on a durable medium.

The contract is concluded in the language of the site in which you complete it, and is archived in Agnetia's systems and the payment provider's.

The wallet and top-ups

  • Part of the fee goes each month into a wallet denominated in euros that is yours, and is drawn down as you use the voice and the two review exercises written by the artificial intelligence. The breakdown is on How it works.
  • What you do not spend accumulates month over month, with no cap and no expiry, for as long as the account is active.
  • When the balance reaches zero the speak button switches off and the rest of the platform keeps working. There are no automatic charges above the fee, and no negative balance.
  • You can top up whenever you like, for any amount above a minimum, paying on the payment provider's screen. There is a per-operation ceiling and daily and monthly caps per account.
  • The balance is credit towards use of the service: it is not electronic money, it earns no interest and it cannot be transferred to another account or cashed out, except in the withdrawal and termination-for-breach cases described below.

Duration, renewal and cancellation

  • The contract is open-ended with monthly cycles, and renews automatically each month unless you cancel.
  • You can cancel whenever you like, yourself and from your profile, without writing to anyone, without giving reasons and without penalty.
  • Cancellation takes effect at the end of the period already paid for: you can keep practising until then.
  • When cancellation completes, any balance left in the wallet is lost, whether it came from the fee or from a top-up. It is worth spending it before the paid period ends. This consequence is highlighted here because it is not obvious and because cancellation is completed on the payment provider's screen, where we cannot remind you.
  • Cancelling and signing up again does not return a lost balance and does not open another 24 hours of courtesy.
  • You can also delete the whole account from the platform. Doing so cancels the subscription first, so no live charge is left behind.

Right of withdrawal

If you are contracting as a consumer, you have fourteen calendar days to withdraw without giving any reason and without penalty.

The period is fourteen calendar days from the conclusion of the contract, that is, from when you register the payment method. To exercise it, simply tell us your decision unambiguously through any of the contact channels, or using the form reproduced below. Using it is not compulsory.

By starting to use the service during that period — speaking a turn, doing an exercise — you expressly request that performance begin before it ends, and you acknowledge that if you then withdraw, you must pay for the proportion already supplied. That is the only deduction applied: the rest is refunded.

If you withdraw, you will be refunded what you paid less that proportional part, by the same means of payment you used and within a maximum of fourteen calendar days from receipt of your notice.

Note that cancelling and withdrawing are not the same thing. Cancelling ends the service at the end of the period and refunds nothing; withdrawing, within the first fourteen days, does refund.

Failed payment and suspension

  • A failed charge does not cut off access immediately: it is retried over several days and you can keep practising meanwhile.
  • If the retries run out, the account is suspended. The wallet balance is kept in full and becomes available again as soon as you settle up. The asymmetry with voluntary cancellation is deliberate: someone who could not pay can come back.
  • You can update your payment method at any time from your profile.

Acceptable use

  • The service is for learning languages. It may not be used for anything else or in a way that harms its operation.
  • You may not share the account, automate use of the agent, extract the syllabus or teaching material in bulk, or reuse them to build a competing product.
  • You may not attempt to reach other people's accounts or the systems behind the service, nor run security testing without prior written authorisation.
  • A serious or repeated breach of this section may lead to suspension or termination of the contract, with prior notice unless the seriousness does not allow it. In that case you will be refunded the part of the fee corresponding to the period not enjoyed and the wallet balance that came from top-ups.

Intellectual property

The subscription gives you a personal, non-exclusive, non-transferable and revocable right to use the platform and its teaching material, for the duration of the contract and for your own learning.

It transfers ownership of nothing: the software, the syllabus, the name and the material remain the owning company's or its licensors'.

What you produce by using the service — your answers and your progress — is yours. How it is handled is in the Privacy policy.

Warranties and liability

  • The service is provided in accordance with the description published on About us and How it works, which is the one that counts.
  • We work to keep it continuously available, but we do not guarantee the absence of interruptions, errors or maintenance. A prolonged interruption attributable to Agnetia gives you the right to the proportional part of the fee.
  • Corrections are generated by an artificial intelligence system and may contain errors. They do not replace a teacher and should not be the only source where linguistic accuracy is decisive.
  • If the digital service does not conform, you have the rights in articles 115 and following of Spanish Royal Legislative Decree 1/2007: bringing it into conformity, a price reduction, or termination of the contract, as the case may be.
  • Nothing here excludes or limits liability for wilful misconduct, gross negligence, personal injury, or anything else the law does not allow to be limited towards consumers.

Changes to the service and to the price

  • The service may evolve: adding exercises, changing the provider of an artificial intelligence model, or improving how it works. Such changes do not alter the essence of what you bought.
  • If a change substantially reduces what you bought, you will be given reasonable notice and may terminate the contract without penalty before it takes effect.
  • The price may rise, always with notice. An increase is announced in advance, applies to all learners alike — including those already subscribed — and anyone who does not want to continue can cancel before it affects them, without penalty.
  • These terms may be updated. The version in force is the one published here, with its date. A substantial change will be communicated to you by email before it takes effect.

Complaints, applicable law and courts

If something does not work or does not add up, write to us first from Support inside your account, or to the contact email once it is published. Every complaint is answered within a maximum of one month.

If you are not satisfied, you can go to the consumer authorities of your region or of your country of residence. Agnetia is not currently signed up to any consumer arbitration scheme; if it were, it would be stated here.

The contract is governed by Spanish law. If you are a consumer resident in the European Union, you keep the protection of your country's mandatory rules and may sue in the courts of your own domicile.

If any clause of these terms turns out to be void, the rest remains valid and will be interpreted in the way closest to its purpose.
